  4. Merchandise Policy

    1. What is Audiogalaxy's return policy?

      Products sold directly by Audiogalaxy.com are covered by a 30-day, money back guarantee, against defects (60-days for international customers). Unopened music, tapes, videos, or software may be returned within 30 days of the invoice date for a refund or replacement. Opened music, tapes, videos, or software may be returned only if defective and will be replaced with a new copy. If an item is no longer available, a replacement or refund will be provided. Refunds are mailed out within 30 days (60-days for international customers) in the form of a check payable in US dollars.

      Sales tax is refundable; shipping and handling charges are not. A 20% restocking fee will be charged for each returned item. Defective merchandise may be returned for exchange without a restocking fee.

    2. Hardware Replacement Policy

      Hardware purchased directly from Audiogalaxy.com. and found to be defective may be returned to Audiogalaxy.com within 30 days (60 days for international customers) for replacement or a refund. After 30 days (60 days for international customers) all returns must go directly to the manufacturer or publisher of the product. See the manufacturers warranty information for details.

      All hardware returns must be in the manufacturer's original packaging. The carton must include all the items and components originally packaged with the product (cables, software manuals etc.). To order a replacement for defective hardware from Audiogalaxy.com, first mail the defective item to the shipping address shown on your invoice. Second, complete a new on-line order and check the box marked "replacement." When the defective item is received at Audiogalaxy.com, its replacement will be shipped to you. You will receive credit for the price plus shipping and handling.

      All products sold by Audiogalaxy.com. are third party products subject to any applicable warranties and representations of their respective manufacturers. Accordingly, Audiogalaxy.com.com makes no representations or warranties with respect to any product it sells. Audiogalaxy.com's sole liability and your sole remedy is that Audiogalaxy.com.com will process product returns in the manner outlined in Audiogalaxy.com.com's return policy.

    11. What type of notification do I need to send so Audiogalaxy can process my DMCA request?

      `(3) ELEMENTS OF NOTIFICATION-

      `(v) A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

      `(vi) A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

      `(B)(i) Subject to clause (ii), a notification from a copyright owner or from a person authorized to act on behalf of the copyright owner that fails to comply substantially with the provisions of subparagraph (A) shall not be considered under paragraph (1)(A) in determining whether a service provider has actual knowledge or is aware of facts or circumstances from which infringing activity is apparent.
